1. Acceptance of Terms
By accessing or using the ClubUp platform ("Service"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, do not use the Service. These Terms apply to all users, including golf course operators, league administrators, and individual players.
2. Description of Service
ClubUp provides a golf tournament and league management platform that includes live scoring, real-time leaderboards, course voting, GPS distances, group management, and player statistics tracking. The Service is available via web browsers and mobile devices.
3. User Accounts
To use the Service, you must create an account with a valid email address and password. You are responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account. You agree to notify us immediately of any unauthorized use of your account.
You must be at least 13 years of age to create an account. If you are under 18, you represent that you have your parent or guardian's permission to use the Service.
4. User Conduct
You agree not to:
- Use the Service for any unlawful purpose
- Submit false or misleading information
- Interfere with or disrupt the Service or its servers
- Attempt to gain unauthorized access to other accounts
- Use the Service to transmit harmful, offensive, or inappropriate content
- Scrape, crawl, or use automated tools to extract data from the Service
5. Tournament & Score Data
You retain ownership of all scores, statistics, and tournament data you submit to the Service. By submitting data, you grant ClubUp a non-exclusive license to store, display, and process that data as necessary to provide the Service. Tournament results and leaderboard data may be visible to other members of your group or league.
6. Payments & Entry Fees
ClubUp facilitates the tracking of tournament entry fees and payouts but does not process financial transactions. Any monetary exchanges between users (entry fees, winnings, etc.) are handled outside the platform. ClubUp is not responsible for disputes regarding payments between users.
7. Intellectual Property
The Service, including its design, features, code, and content (excluding user-submitted data), is the property of ClubUp and is protected by applicable intellectual property laws. You may not copy, modify, distribute, or create derivative works based on the Service without prior written consent.
8. Service Availability & Modifications
We strive to keep the Service available at all times but do not guarantee uninterrupted access. We reserve the right to modify, suspend, or discontinue any part of the Service at any time. We will make reasonable efforts to notify users of significant changes.
9. Limitation of Liability
To the maximum extent permitted by law, ClubUp shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of the Service. This includes, but is not limited to, loss of data, loss of profits, or damages resulting from reliance on scores or statistics provided by the Service.
10. Termination
We may suspend or terminate your account at any time for violation of these Terms or for any other reason at our discretion. You may delete your account at any time. Upon termination, your right to use the Service will immediately cease.
11. Changes to Terms
We may update these Terms from time to time. We will notify users of material changes via the Service or by email. Your continued use of the Service after changes are posted constitutes your acceptance of the updated Terms.
